The Promise

Your photos are not training data. And they never will be.

Our promise has six points.

  1. Your photographs will never be used to train, test, or improve an AI model.

  2. Your photographs will never be sold or licensed to anyone.

  3. No future change will rewrite the rules for photographs you have already uploaded or delivered.

  4. Your copyright and licences will always remain yours.

  5. You choose who receives a gallery. When you delete it, we delete its photographs and derived files from our storage.

  6. If the law requires us to retain or disclose specific photographs, we will do only what it requires, tell you unless prohibited, and never use those photographs for model training.

These are the promises. The words on the right are the terms that bind ShotBreak to every one of them. Nothing here depends on where a file happens to sit.

The promise

Terms of Service §16.6, Use of Your Photographs, verbatim

Never used to train a model

We do not use your photographs, or any derivative of them, to train, fine-tune, evaluate or improve any machine-learning model.

Never sold or licensed to anyone who would

We do not grant, sell or licence your photographs to any third party for that purpose or any other.

Never switched on by a future update

Any change to this clause is published with a date, and the version it replaces stays readable. No change to this section applies retroactively to photographs uploaded or delivered before the change. This section binds ShotBreak and any successor to or assignee of our business.

Copyright and licence stay yours

You keep all copyright and licence in the photographs you open, develop, export or deliver using ShotBreak.

A gallery goes to the client you chose

Photographs in a gallery you send are shown to the recipients you choose, and are deleted from our storage when you delete the gallery. Deletion removes the original files, RAW masters, thumbnails, previews, enhanced versions, and derived representations of those photographs from our storage.

A legal demand changes none of this

If a law, court order, or a binding preservation or disclosure demand requires us to retain or disclose specific photographs, we do so only to the extent and for the time the requirement compels, we tell you unless the law prohibits it, and we never use those photographs to train, fine-tune, evaluate, or improve any model. No law requires model training, and no legal demand changes the commitments in this section.

Copied word for word from the terms of service. The terms are the binding document.

When you send a gallery

The one action that moves photographs, and the one we get paid for. Unchanged by that:

What we do with them
Show them to the client you chose.
Anyone at ShotBreak
Only if you ask, or the law requires.
Copyright and licence
Yours, unchanged.
Used to train a model
Never, in any version.
If you delete the gallery
Deleted from our storage too.
